1. Acceptance of Terms
By using BidPounce (“the Platform”), you agree to these Terms of Service.
2. How BidPounce Works
BidPounce is a marketplace connecting travelers with tour operators. Customers name their price, and operators compete by making offers. When a customer accepts an offer, a binding contract is formed between the customer and the operator.
3. Payment Terms
3.1 For Customers: Your credit card is saved at the time of posting a request but is NOT charged unless:
- You fail to show up for your booked tour AND fail to pay the operator directly
- You dispute a valid no-show charge after BidPounce has already paid the operator
3.2 For Operators: You collect payment directly from customers. BidPounce only charges the customer’s card as a last resort for no-shows.
4. ID Requirement
The person whose credit card is saved on BidPounce MUST be present at check-in with a valid government-issued ID. If the cardholder is not present, the customer will not be permitted to fly and no refund will be issued.
5. Cancellations & Refunds
5.1 Operator Cancellations: If an operator cancels for weather (WX), maintenance (MX), TFR, or national disaster, customers will receive a full refund of any commission paid.
5.2 Customer No-Shows: Customers who fail to show up and do not pay the operator directly may be charged the full tour price via their saved card.

7. Limitation of Liability
BidPounce is not liable for any injuries, damages, or losses occurring during tours. All activities are at your own risk.
8. Governing Law
These terms are governed by the laws of the State of Hawaii.
